The Regional Justice Act An Act to Establish the Justice System of Ascotera
Section I: Criminal Complaints 1.All Citizens, as well as the government of Ascotera, have the right to lodge a complaint against any other Citizen, should they believe to have violated any section of the Constitutional Criminal Code, or any law that has been passed by this body. 2.Complaints will be submitted in the Ascotera Criminal Complaints Forum.
Section II: The Head Justice 1.The Head Justice shall be the Head of the Judicial Branch of the Regional Government of Ascotera. 2.The Office of Head Justice shall be held by any Citizen who meets the requirements to do so (i.e. is not the Premier or a Senator). 3.Candidates for Head Justice shall be nominated by the Premier, and shall take office upon their approval by majority vote of the Senate. 4.Head Justices shall serve until their resignation or the nomination and approval of a new Head Justice.
Section III: The Court and Trial 1.The Head Justice shall preside over all criminal cases. 2.Only one case may be heard at a time. 3.Cases must be heard as soon as possible (i.e. upon the launching of the complaint in no complaint is currently being heard, or the conclusion of the previous trial) in the order in which they were lodged. 4.Upon the beginning of the hearing of a complaint, the accused must be notified by telegram by the Head Justice within 24 hours. 5.Also upon the beginning of the hearing of a complaint, the following must happen within 120 hours (5 days): a.The plaintiff must present evidence of the offence to the Head Justice. b.The defendant must present evidence of defense to the Head Justice. c.The Head Justice and defendant must each concur on the selection of between two and four Citizens who are not already involved in the case to serve as jury members, who must then be notified of their involvement by telegram by the Head Justice. 6.Upon the lapsing of 120 hours following the beginning of the hearing of the complaint, the evidence shall be provided to the jury, who shall then deliberate. 7.Upon presentation of the evidence, the jury shall have 24 hours to render a unanimous verdict and present it to the Head Justice. a.The Jury may submit questions to either the plaintiff or defendant, that they are not required to answer b.If after 24 hours of deliberation the decision is not unanimous, the jury must report thusly to the Head Justice, at which time he may either order the jury to deliberate for another 24 hours, or declare the jury hung. c.Jurors’ verdict must not be influcened by anything other than the evidence provided. 8.A case in which the jury is declared hung shall be deemed void, and the complaint shall be placed on the backend of the trial docket to be heard again. 9.Cases that render a verdict in favor of the defendant shall end all deliberation on the topic. 10.Cases that render a verdict in favor of the plaintiff shall then go into sentencing, wherein the defendant’s punishment, should it not be already prescribed by law, shall be decided by the Head Justice, who shall then notify the defendant by telegram within 24 hours, coming into effect immediately upon the latter’s notification.
Section IV: Trial Non-compliance 1.Should the following occur, it shall result in the dismissal of the case: a.The plaintiff does not supply any evidence within the allotted time. 2.Should the following occur, it shall result in the immediate conviction of the defendant: a.The defendant does not supply any evidence in the allotted time. b.The defendant does not give correspondence to the Head Justice on jury selection. 3.Should the following occur, it shall result in the immediate rehearing of said trial: a.The Head of Justice does not notify the defendant within the allotted time. b.The Head of Justice does not give correspondence to the defendant on jury selection. c.The jurors do not give updates on their verdict within the allotted time.
Section V: Further Actions after trial 1.Neither plaintiff nor defendant may appeal a verdict; should they believe something in the process to have been illegal, they may lodge a new criminal complaint. This includes presentation of false evidence and jury tampering. 2.Should a trial find a previous trial be have been conducted illegally, the original verdict shall be overturned, and new sentencing shall be handed down, which must be at least as harsh as the original punishment. 3.Citizens cannot be placed in double jeopardy.
Section VI: Miscellaneous 1.If selected, jurors MUST take part in a trial, or be held criminally liable. 2.The Premier shall direct an official to bring forth cases on behalf of the Regional Government. 3.Officials, should they meet the prescribed requirements, may act as jurors. 4.In complaints against the Head Justice, his duties shall be performed by the Founder.
