Konge of Asgard
|
Constitution of Asgard Preamble We, the people of Asgard, have convened to establish the Realm of Asgard and this Constitution according to which it will be governed. We pledge that the Realm of Asgard will be guided by the principles of individual liberty, monarchist unity, participatory government, and mutual cooperation between all residents and citizens of Asgard. This Constitution will serve as a covenant between us to uphold these shared values in all matters of state and government. I. Konge of Asgard Recognizing the authority of the Konge as head of state (1) The Konge will serve as head of state for Asgard, and will serve until abdication. The Konge will have final authority over all external policy, including foreign affairs, military policy and operations, security, intelligence, and counterintelligence. (2) The Konge may select a citizen to serve as Heir Apparent. The Konge may grant additional titles and stylings to the Heir Apparent, may delegate his authority to the Heir Apparent as he deems appropriate, and may dismiss the Heir Apparent. (3) The Heir Apparent will succeed the Konge in the event of his abdication. In the event of succession, all titles, stylings, and pronouns of the Konge in this Constitution and any law may be altered according to the gender identity of the successor. Defining the powers of the Konge (4) The Konge will serve as chief administrator and moderator of the game-side region. The Konge may administer game-side regional settings, administer game-side regional recruitment, assign and dismiss game-side Regional Officers, and set forth game-side moderation policies. (5) The Konge will serve as chief administrator and moderator of off-site regional property. The Konge may administer off-site settings, assign and dismiss off-site administrators and moderators, and set forth off-site moderation policies. (6) The Konge will guarantee the out-of-character safety and security of the game-side region, off-site regional property, and all participants in the game-side region or off-site regional property. The discretion of the Konge to guarantee out-of-character safety and security will be absolute. (7) The Konge will be the commander-in-chief of the Great Heathen Army, the sole military force permitted to operate on behalf of Asgard. The Konge may delegate his authority over the Great Heathen Army to a chain of command. (8) The Konge may participate in any negotiations, conferences, or events with other regions or organizations. In the event of participation in an organization that requires regional representation, the Konge may serve as the representative or appoint the representative. (9) The Konge may, with the two-thirds approval of the Folketing, declare war against another region or organization and rescind declarations of war. The Konge may, with the absolute majority approval of the Folketing, declare another region or organization hostile, proscribing participation in that region or organization by any resident or citizen of Asgard, and rescind such declarations. (10) The Konge may, in the event of a vacancy in the Folketing, initiate a special election if he determines that there is sufficient time remaining in a term to warrant a special election. If the Konge determines that there is not sufficient time remaining in a term, the vacated seat in the Folketing will remain vacant for the remainder of the term. (11) The Konge may legislate by royal decree in relation to all matters. Before becoming law, such legislation will be subject to absolute majority approval by citizen referendum, or should such legislation amend this Constitution, two-thirds approval by citizen referendum. (12) The Konge may assent to any legislation passed by the Folketing, which must be promptly presented to the Konge by the Folketing. Should the Konge withhold his assent from legislation passed by the Folketing, such legislation will not become law. (13) The Konge may, during an intractable period of chronic inactivity or destabilizing dysfunction, dissolve this Constitution, initiating a constitutional convention comprised of all citizens. The Konge may provide for full regional governance during an interim period in which there is no constitution. The power of the Konge to dissolve the Constitution will be an emergency power which may be further regulated by law. (14) The Konge may, with the absolute majority approval of the Folketing, declare any person persona non grata, barring them from residence or participation of any kind in Asgard, and rescind such declarations. (15) The Konge may, with the absolute majority approval of the Folketing, pardon or commute the sentence of any person convicted of any crime by the Højesteret. Removal of the Konge (16) If the Konge fails to post on the off-site regional forum for a period of thirty days or longer, and is certified as absent without notice by a two-thirds vote in the Folketing, the question of removing the Konge will be referred to citizen referendum, subject to two-thirds approval. Should the Konge be removed, the Heir Apparent will succeed him as though the Konge had abdicated. II. Folketing of Asgard Establishing the composition and legislative authority of the Folketing (1) The Folketing will be the legislature of Asgard, comprised of no less than three and no more than nine citizens elected by the citizenry to serve as Folketing Members for two month terms. The number of seats in the Folketing for each two month legislative session will be determined by the Konge prior to voting in a general election for the Folketing. There must always be an odd number of seats in the Folketing. (2) Elections for the Folketing will be conducted once per month, with each election period beginning on the first day of the month. Elections will be staggered so that a majority of the Folketing's seats will be filled during general elections in the months of January, March, May, July, September, and November, and the remaining seats will be filled during midterm elections in the months of February, April, June, August, October, and December. Defining the powers of the Folketing (3) The Folketing will, following general election for the Folketing, elect a Formand to preside over the Folketing according to rules and procedures established by law or, in the absence of such law, according to rules and procedures established by the Formand. The Folketing may elect a new Formand at any time during a legislative session. (4) The Folketing may, by absolute majority vote, pass legislation in relation to all matters, and may, upon the request of the Ministerråd, ratify, amend, or repeal legally binding agreements with other regions and organizations. Such agreements constitute legislation, subject to royal assent. (5) The Folketing may, by absolute majority vote, propose removal of a Folketing Member, the Statsminister, the Delegeret, a minister, or a deputy to any official from office. A Folketing Member may not vote in the Folketing on their own removal from office. The question of removal from office will then be referred to citizen referendum, subject to two-thirds approval. (6) The Folketing may, by two-thirds vote, pass legislation to amend this Constitution. Such legislation will be subject to two-thirds approval by citizen referendum, according to procedure established by law. Citizen referendums will be administered by the Formand or, in the absence of the Formand, by the Konge. III. Ministerråd of Asgard Establishing the executive responsibilities of the Ministerråd (1) The Ministerråd will be the executive government of Asgard, governing Asgard in the name of the Konge and subject to his final authority over external policy. The Konge will be invited to all meetings of the Ministerråd and regularly informed regarding its activities. (2) The Ministerråd will be comprised of citizens and responsible to the citizenry, represented by the Folketing. The Ministerråd will regularly report on its activities to the Folketing or directly to the citizenry, as determined appropriate for regional security. Establishing the Statsminister as head of the Ministerråd (3) The Statsminister will be a citizen elected by the citizenry every two months, or whenever the office of Statsminister is vacant. (4) The Statsminister will be the head of the Ministerråd and may appoint and dismiss ministers and deputies of the Ministerråd. The Statsminister will preside over all meetings of the Ministerråd, and will be responsible for setting the executive agenda and coordination of executive activities. (5) The Statsminister may appoint a minister to serve as Deputy Statsminister. The Deputy Statsminister will assist in heading the Ministerråd and will serve as Acting Statsminister in the event that the Statsminister is absent. The Statsminister may dismiss the Deputy Statsminister. IV. Højesteret of Asgard Establishing the composition and judicial authority of the Højesteret (1) The Højesteret will be the judiciary of Asgard, which will be led by the Præsident Dommer, a citizen appointed by the Konge to an indefinite term. The Præsident Dommer may be dismissed by the Konge or by two-thirds vote of the Folketing. (2) In the event of appeal, the Konge will appoint a panel of three citizens to serve as Dommere. Dommere may be dismissed by the Konge or by two-thirds vote of the Folketing, and will automatically be dismissed following resolution of the appeal to which they are assigned. (3) The Konge will appoint a citizen to serve as Acting Præsident Dommer as needed. The Acting Præsident Dommer may be dismissed by the Konge or by two-thirds vote of the Folketing. (4) The Konge will appoint a Rigsadvokaten responsible for law enforcement and prosecution of criminal charges, and who will have automatic standing before the Højesteret. The Rigsadvokaten may be dismissed by the Konge or by two-thirds vote of the Folketing. (5) The Rigsadvokaten may appoint citizens as deputies to assist in law enforcement and prosecution of criminal charges, and may dismiss such deputies. Defining the powers and original jurisdiction of the Præsident Dommer (6) The Præsident Dommer will preside over the Højesteret according to rules and procedures established by law or, in the absence of such law, according to rules and procedures established by the Præsident Dommer. (7) The Præsident Dommer will have original jurisdiction over all cases before the Højesteret, unless the Præsident Dommer determines that a conflict of interest requires recusal. The Præsident Dommer may defer original jurisdiction to an Acting Præsident Dommer in the event of absence or unavailability. Defining the appellate jurisdiction of the Dommere (8) Upon appeal by the petitioner or defendant in a case, a panel of three Dommere may, by absolute majority vote, uphold or overturn a ruling, in whole or in part. Appeals will be heard only once, according to rules and procedures established by law or, in the absence of such law, according to rules and procedures established by the Præsident Dommer. Defining the powers of the Højesteret (9) The Højesteret will strike down any law, in whole or in part, that contradicts this Constitution, will resolve contradictions between laws of equal authority, and will order restraint, cessation, or redress of any governmental policy or action that violates the law. The Højesteret may only exercise this power if publicly petitioned to do so by an affected petitioner or a petitioner who has been granted automatic standing by law. (10) The Højesteret may hear criminal charges publicly brought by the Rigsadvokaten or their designated deputy, decide a verdict of guilty or not guilty for such charges, and determine sentencing for guilty parties according to standards established by law. The Rigsadvokaten or deputy designated for prosecution will be regarded as the petitioner in any criminal case. V. Delegeret of Asgard Establishing the office of the Delegeret (1) The Delegeret will be a citizen elected by the citizenry every four months, or whenever the office of Delegeret is vacant, to serve as World Assembly Delegate of Asgard. (2) The office of Delegeret will automatically be vacated if the Delegeret's nation in Asgard ceases to exist, relocates, or ceases to be in the World Assembly. (3) The Delegeret may be included in the Ministerråd as a minister or invited to meetings of the Ministerråd at the discretion of the Statsminister. (4) The Delegeret may appoint citizens as deputies to assist in encouraging and facilitating participation in the World Assembly and may dismiss such deputies. Establishing the responsibilities of the Delegeret (5) The Delegeret will be responsible for encouraging participation in the World Assembly by promoting game-side enrollment in the World Assembly, as well as facilitating and promoting citizen voting in the World Assembly. The Delegeret may establish other activities, events, and programs related to the World Assembly. (6) The Delegeret will be responsible for voting in the World Assembly according to the directive of the Konge or, if no such directive has been issued, according to votes cast by citizens via the off-site regional forum. (7) The Delegeret will be responsible for approving or withholding approval from proposals for the queue of each World Assembly chamber according to the directive of the Konge or, if no such directive has been issued, at the discretion of the Delegeret. (8) The Delegeret will be responsible for maintaining as high an endorsement count as possible by regularly soliciting the endorsements of game-side World Assembly nations. Protecting the game-side position of the Delegeret (9) The Konge may determine regional endorsement limits to protect the game-side position of the Delegeret as World Assembly Delegate. Any nation in violation of endorsement limits may be summarily ejected from the region. The Konge may defer determination of endorsement limits to the Delegeret. (10) Two endorsement limits will be established, one for nations that are not endorsing the Delegeret and a higher limit for nations that are endorsing the Delegeret. No other endorsement limits will be established. VI. Separation of Powers Establishing the apolitical nature of the monarchy (1) The Konge will be prohibited from serving in any other office or as deputy to any other office. This prohibition will not be construed to limit the Konge's participation in any executive or general regional activities. (2) The Heir Apparent will not be permitted to exercise any authority delegated by the Konge while serving in any other office or as deputy to any other office. This will not be construed to prevent the Heir Apparent from exercising authority delegated by the Konge in another capacity. Establishing the independence of the judiciary (3) The Præsident Dommer, Acting Præsident Dommer, and Rigsadvokaten will be prohibited from serving in any other office or as deputy to any other office. This prohibition will not be construed to limit their participation in any executive or general regional activities. (4) When appointing an appellate panel of Dommere, the Konge will endeavor to appoint citizens who are not serving in any other office or as deputies to any other office. The Konge will ensure that Dommere are free of conflict of interest in relation to the case under appeal. Establishing additional separation of powers (5) No person may simultaneously serve as Statsminister and Formand. This will not be construed to prevent a person from running for election to one such office while holding the other, but will automatically resign such a person from the other office upon election. VII. Citizenship and Rights of Citizenship Establishing procedure for admission of citizenship (1) Residents of Asgard may be admitted to citizenship by the Konge, according to rules and procedures established by law or, in the absence of such law, according to rules and procedures established by the Konge. (2) The Konge may delegate responsibility for admitting residents to citizenship and revoking citizenship to the Heir Apparent and/or the Ministerråd. Defining the rights of citizenship (3) Citizens will enjoy freedom of expression, speech, assembly, and the press, subject only to laws and moderation policies that reasonably serve to preserve the peace, order, and security of the region and community. (4) Citizens will enjoy the right to fair trial and defense against criminal charges. No citizen will be subject to a bill of attainder, ex post facto trial, or double jeopardy. (5) Citizens have the right to vote and, if duly elected or appointed, hold office, unless otherwise mandated by this Constitution. VIII. Election Administration Establishing procedure for administration of elections (1) Elections will be administered by the Konge. The Konge may delegate election administration to the Heir Apparent or to an appointed election administrator. No election administrator may be a candidate in the election(s) they are administering. (2) Elections will be administered according to rules and procedures established by law or, in the absence of such law, according to rules and procedures established by the Konge.
