Would you agree that if the law doesn't say something is illegal then it isn't illegal? |

Sure, I'll agree to that. But I won't agree to think it's a good idea to give all that power to one person. |

I didn't ask you if you agreed to that. So you agree that if the law doesn't say it's illegal then it's legal. You also agree that the law is clear all the time, which you've already stated in this very thread. So, if the law is always clear, and if anything not covered by it is legal, then when should the law ever need be questioned? Why would you need three people to debate the legality of something if it's always clear? The more people you give this power to, the longer it takes to reach decisions and the more likely you are to not be able to act on something. Edited by Momo, Jan 16 2018, 04:28 PM.

I feel the need to repeat, this amendment gives no actual judicial power to the MoDA that it didn't have before the court system was created anyway. Rather, it just gives the MoDA the responsibility of knowing the CK law and understanding it. The power to see and respond to violations of our rules and laws is returned to all officials, without the need for a judiciary to find them guilty. They still need to be able to publicly explain their actions and can still be removed from office for overstepping or misuse.

Sooo, you're saying the MoDA is now required to know the law..... just like every other regional member? That line causes all kinds of confusion. Is there going to be a monthly test to make sure the MoDA knows the law?

That's pretty much what I'm saying yes. Though, your comment appears to be stupidity for the sake of stupidity, the answer to your first question is yes. Except, officially, there is no official who needs to actually know the laws of CK. This just makes it official

That seems slightly pointless to include that. Why not just require all officials to have a working knowledge of the law? |

Why not just make it the job of one to know it better than any other? Also, a "working knowledge" is far different from knowing and understanding the law. Working knowledge is knowing without understanding, and thus is entirely pointless to require because they are just spouting useless knowledge. |

Because if everyone knows it, then we wont have to have one interpret it. No one will be in disagreement about what should be done because, as you have stated, the law isnt unclear. |

I'm not saying everyone shouldn't know it. I'm saying make it the job of one person to know it better than anybody else. It's also a mostly mute point, the whole point of it was that officially, nobody at this point in time actually needs to know the laws. All that does is make it the job of somebody to know them. It is pretty impractical to actually require any or all of the officials to know the laws, as there is really no way to guarantee they do. This just officially makes it the job of somebody to know it. Anything they are unclear on should be sought out. It becomes their responsibility. In all honesty, it should be the responsibility of every CK resident, but as I've said countless times already, that line just makes it officially the responsibility of somebody. |
