[.............]Summa Carta ex De Arte Pacis [.......]SECTION A Whereas it is in the interests of all to have an efficient system of governance for this project, to ensure justice in rule and the maintenance of good relations between all parties involved, the following document has been drafted in order to establish the basis for the proper administration of this project. Articles I-III discuss the establishment of the Privy Council and its role. Articles IV-VII deal with the disputation process. Articles VIII and after deal with miscellaneous issues, such as penalties and disciplinary action. [.......]SECTION B ARTICLE I. The Game Administrator will establish a Privy Council to assist in the decisions made in the administration of the game. Their primary responsibility will be to provide counsel to the Game Administrator, to provide counsel to the players involved in the game, to serve in the High Court of Disputes and, occasionally, on request, assist in the day to day operation of the game itself, when the Game Administrator is unable to handle the operation itself. ARTICLE II. The Privy Council will consist of between three and five members appointed by the Game Administrator, and will be chosen from people that are known for their good character, their judgement, their knowledge, and their availability, in that order. Their term will be indefinite until they either resign their position or are replaced by the Game Administrator. ARTICLE III. Game counsel. a. To elaborate on the responsibility of the Privy Council to provide counsel to the game's participants, each Councillor will be given a specific area of the game for which participants will come to them first for advice. The division of responsibility will be determined based on the expertise and experience of the individual council members, but will include, although not be limited to, a Council member for Technology, for Domestic Politics, for War, for International Diplomacy, for Finance and Economics, for Colonies and Domestic Overseas Affairs. In addition to these, certain Council members will be designated the Resident Expert on specific geographical areas. b. As it will be noted, Council members will be asked, as they are able, to take on multiple areas of expertise, and in some cases, there may be Council members who will share the same areas of expertise, especially for the more onerous or extensive areas. [.......]SECTION C ARTICLE IV. The Game Administrator will establish a High Court of Disputes in order to ensure the appropriate, just, and quick, handling of disputes between game members. If there is any out of character issue relating to the game, between two or more individuals, that cannot be settled privately, and pistols at dawn -- no matter how preferable -- have proven to be impracticable, the dispute will be brought to this court via the process set forth in the following articles. Any attempts to deal with the matter publicly in any other fashion, or to circumvent this court in any way, will be dealt with strictly and may result in a variety of bans, probations, or other penalties, on the discretion of the Game Administrator. ARTICLE V. The Game Administrator, or any individual who he selects to be his representative, will preside over the court as the Judge, and the Privy Council members will serve as the Jury. The Judge will have the final say in the matter, taking in to account the recommendations of the Jury. ARTICLE VI. If a member of the Privy Council is either a litigant or named in the defence, they will not be able to sit on the Jury. The Game Administrator reserves the right to add or remove those named as litigants or defence at his discretion. ARTICLE VII. The disputation process. a. The litigant(s) will file a dispute claim to the Game Administrator. It must follow the pattern attached in Appendix A, any deviation will not be accepted. b. The dispute claim will be presented, as is, to the court, and will serve as the basis for the litigant(s) complaint. Neither the litigant(s) or the defence will be permitted to address the court directly. Once the claim is presented, it cannot be modified in any way. If there are multiple litigants in one claim, they must present one claim, although they are permitted to each add their own section. c. Through the Game Administrator, the defence will present their response to the litigants claims. Each person named on the defence will have one opportunity to respond. d. After the defence have made their response, or waived their right to respond, the Jury will have a twenty-four hour period to deliberate on their response. At this stage, the litigant(s) or defence may be requested to answer further questions regarding the case. This will be done publicly, and the individual in question will be permitted one response to each question. Any attempts to address anything but the question may result in their case being thrown out, probation, bans, or other penalties. The Judge reserves the privilege to extent the twenty-four hour period of deliberation depending on circumstances/ e. After private deliberation, which will, if necessary, include a vote, the Jury will deliver their solution to the court. The Judge will make the final decision on the resolution of the claim. [.......]SECTION D ARTICLE VIII. Any powers and privileges not discussed in this document will be considered the sole reserve of the Game Administrator, to exercise, to delegate, or to dispose, at his discretion. He also retains the right to modify this document at any time. ARTICLE IX. Penalties and disciplinary action. a. Any member ban will include a specific length of time, either non-permanent or permanent. Revocation of any ban will take place only after a very careful and deliberate process of appeal. b. At the discretion of the Game Administrator, any member may be placed under Probabtion. This entails that any in character actions taken by the member under probation will need to be approved by either the Game Administrator, or anyone he chooses to represent him on a case by case basis. Attempts to circumvent this probation will result in further penalties. ARTICLE X. Free Speech. There is none. ARTICLE XI. Poise. Sting like a bee. Do not float like a butterfly. That's ridiculous. |
