The Constitution of Dythinia

Preamble

This document and all of the articles herein shall be the supreme law of the land, and will overrule any contradicting legislation. The people of Dythinia are granted the basic human rights, the right to democracy and the idea of the Republic.

Article 1: The Guardian

1.1 The Guardian shall retain permanent administration rights to the region, and shall act as the overseer of the region.

1.2 In the event the Guardian shall CTE, the President shall take over any roles that previously belonged to the Guardian.

1.3 The Guardian shall be tasked with carrying out the orders of the Judiciary and the Government. They shall also manage the regional message board.

1.4 The Guardian can declare a state of emergency.

1.5 The Guardian can issue executive orders that may overrule all laws. The Guardian may also amend the constitution.

1.6 The Guardian may call early elections.

1.7 The Guardian controls the regional founder account.

1.8 The Guardian may remove any other regional official.

Article 2: The President

2.1 The President shall be the elected leader of the region.

2.2 The President shall have the right to select his cabinet whenever he wishes. The President may also choose and/or change his Vice President. The President will run the day to day operations of the region.

2.3 The term of President shall last a maximum 2 months.

2.4 The President may be removed by the Guardian. If the President is removed, Presidential Elections shall follow.

2.5 The President may issue an executive order, that shall be instantly written into law. However, it can be overturned by Congress with a simple majority vote. The President may not edit the Constitution with an executive order.

2.6 The President can veto a piece of legislation that has been passed through Congress. It requires a 2/3 vote to overturn.

Article 3: The Vice President

3.1 The Vice President shall be the deputy leader of the region.

3.2 The Presidential candidate shall choose a running mate prior to a Presidential Election. If the President and the running mate win, the running mate shall become the Vice President.

3.3 A citizen may only serve as Vice President for 2 terms.

3.4 The Vice President shall assist the President in day to day regional matters, and shall serve as his senior advisor.

3.5 The Vice President may be removed by the President, or the Guardian.

3.6 If there is a tie in Congress, the Vice President shall have a tie-breaking vote.

Article 4: Secretaries of State

4.1 Secretaries of State shall be Secretary of State for Foreign Affairs, Secretary of State for Home Affairs and Secretary of State for Communications

4.2 The Secretary of State for Foreign Affairs shall be responsible for creating and maintaining the foreign relations of the region.

4.3 The Secretary of State for Home Affairs shall be responsible for maintaining citizenship and responsible for gaining new members.

4.4 The Secretary of State for Commications shall be responsible for managing the regions communications systems such as the regional forum.

Article 5: Congress

5.1 Congress shall be made of all citizens of Dythinia.

5.2 Congress shall have the ability to pass legislation with a majority vote.

5.3 Congress shall also be able to impeach all regional officials, except the Guardian, with 2/3 of all voting members.

5.4 Congress will be managed by the speaker. The Speaker shall be a representative elected by peers in Congress. The election for speaker shall occur every 2 months on the 20th. The speaker mat be removed by the guardian or peers in the congress. The speaker shall be a voting member of congress, except when being impeached by peers in congress. The Speaker shall be a voting member of Congress, except when being impeached by peers. If there is a tie in the impeachment of the Speaker, the deciding vote shall fall to the Vice President.

5.5 The Speaker shall pass the bill to the President, so he can sign the bill into law, or decide to veto it. A veto requires a 2/3 vote to be overturned.

5.6 The Constitution may not be amended without the approval of Congress, unless it is being amended by the Guardian. It requires a 2/3 vote to amend the constitution.

Article 6: The Grand Court of the Republic

6.1 The Grand Court of the Republic shall be lead by the Grand Judge.

6.2 The Grand Judge’s job shall be to interpret the law and impose punishments on those who violate them.

6.3 A citizen must propose an application against another citizen, with an alleged violation of the law for a case to be overseen by the Grand Judge.

6.4 The Grand Court of the Republic has the authority to review decisions made by the Government and May overturn them, with proof of legal wrongdoing.

6.5 A citizen shall be selected by the President, and confirmed in Congress with a majority vote to become Grand Judge.

6.6 The Grand Judge shall remain impartial at all times.

6.7 A Grand Judge will serve for life, unless removed by the Guardian, or impeached by the Congress.

6.8 An Attorney General may be selected by the President to defend the Government if a legal case against it is pursued

Article 7: Citizens

7.1 A citizen shall be a nation that resides in the region and has registered and has been granted citizenship on the forum

7.2 Citizens shall have the right to freedom of speech, and basic human rights and the right to democracy.

7.3 Citizens shall have the rights to stand in democratic elections.

Article 8: Laws

8.1 Laws begin as a bill. A law shall need to be drafted with all necessary definitions and written in a clean and organised form.

8.2 All proposition of laws will be submitted to the Speaker of Congress for review. During that phase, he/she has the right to block any law should it be deemed unconstitutional or poorly written.

8.3 Should this happen; the Grand Court of the Republic or the Guardian has the right to overrule the Speaker of Congress if he finds that the proposition does respect the constitution and is written in the proper form.

8.4 Laws may be vetoed by the President, requiring a 2/3 vote in Congress to be overturned.

Article 9: Elections

9.1 All elections will begin on the 20th day of the month.

9.2 All elections will last 72 hours.

9.3 All citizens have the right to vote in the elections.

9.4 All citizens elected to a position in the elections will take office on the 1st day of the following month.

9.5 An elected President not yet in office shall be known as President-elect. An elected Speaker not yet in office shall be known as Speaker-elect.
