Preamble In the interest of the common people and acknowledging the necessity of order, stability and the rule of law, the assembled citizens of the Grand Central region thus declare a Commonwealth, built on the principles of democracy, liberty and equal opportunity for all. This constitution, and the text within it, is the founding document and basis for the laws and customs of our region. Article I I. The Commonwealth of Grand Central shall be the governing body of the Grand Central region, with absolute authority over it, and its declared extraregional domains. II. The Commonwealth establishes its authority over the following: a. The region of Grand Central, located here: https://www.nationstates.net/region=grand_central b. The forum of Grand Central, located here: http://s15.zetaboards.com/GrandCentral/index/ c. The official Skype chat of Grand Central, located on the program itself. III. The Commonwealth shall govern Grand Central by the mandate of the citizens, and be composed of citizens. Article II I. The Chancellor is the Head of Government of the Commonwealth. He shall have the final say on setting executive policy for the Commonwealth. II. The Chancellor shall serve for a term of three months. A person shall not serve for more than two consecutive terms in the Office of the Chancellor. III. The Chancellor shall be elected by the citizens of the Commonwealth tri-monthly in a free vote. He must be a citizen of the Commonwealth and a member of the Grand Congress. IV. The Chancellor shall appoint the Magisters to the cabinet. V. The Chancellor has the authority to propose war to the Grand Congress. VI. Supreme executive power is invested in the Chancellery for the purpose of serving, guiding and protecting the people of the Commonwealth. VII. The Chancellor shall have the power to sign or veto any legislation passed by the Grand Congress. If the Chancellor signs the legislation it shall immediately become law. If the Chancellor vetoes the legislation it shall not become law unless the veto is overridden by a two-third majority of the Congress. VIII. The Chancellor shall have the authority to appoint a Vice Chancellor, who in the absence of the Chancellor may make executive decisions related to regional governance. Should the Chancellor resign or be declared unfit for duty by a vote of no confidence by the Grand Congress, the Vice Chancellor will be called to fulfill the rest of the exiting Chancellors term. IX. The Chancellor shall be granted the corresponding regional officer position with every possible authority. X. The Chancellor shall be the primary administrator of the regional Skype chat, and can appoint anyone to help moderate it. XI. The Chancellor is entitled to administration privileges on the regional forum, as well as any of their chosen appointees to assist in those duties. XII. The Chancellor shall have the power to impose legal banishment on any nation and forum account, unless such an action is overturned by the Grand Congress. XIII. The Chancellor has the power to issue an executive pardon of any person convicted of a crime. This pardon can be overturned by the Grand Congress. XIV. The Chancellor may immediately and without obstruction, revoke the citizenship of any Commonwealth citizen. This revocation may be overturned by the Grand Congress. Article III I. The office of the regional delegacy shall be occupied by the Lord Protector of the Commonwealth. II. The duty of the Lord Protector is to defend the Commonwealth from threats both foreign and domestic, and lawfully uphold the rights of its citizens. III. The Lord Protector shall uphold bans imposed by the Chancellor and Grand Congress. IV. The Lord Protector may legally eject and ban any nation in the region for the purpose of security, unless ordered to reverse such an action by the Chancellor or the Grand Congress. V. The Lord Protector shall be nominated by the Chancellor, and confirmed by the Council of Magisters. VI. The Lord Protector may be recalled at any time by the consensus of the Council, the Chancellor and the Vice Chancellor. VII. The Lord Protector may vote on World Assembly resolutions as they see fit. VIII. The Lord Protector will serve at the continued discretion of the Cabinet, which may recall him at any time, or until he is recalled by the Grand Congress. Article IV I. The legislative authority of the Commonwealth is vested in the Grand Congress. II. The Grand Congress shall be composed of every Commonwealth citizen, save for those who have been citizens for a period of under 48 hours. III. The Congress is tasked with checking the power of the executive and representing the will of the people, in order to ensure the region’s democracy and maintain its principles. IV. Any citizen may introduce Congressional legislation, which, if sponsored by two other citizens, will be voted on by the entire Congress in order to become law. V. The Grand Congress shall elect the Chancellor of the Commonwealth, who will retain their voting right. VI. The Grand Congress can submit a motion to legally recall the Chancellor, which must pass with two thirds of the vote. If passed, the Chancellor is immediately deposed, and the Vice Chancellor will assume the position for the remainder of their term. VII. The Grand Congress can also recall the Lord Protector by the same procedure, resulting in a new selection by the Chancellor and approved by the Congress. VIII. The Vice Chancellor shall preside over the Congress, and be responsible for tabling bills, opening voting and monitoring the votes. Article V I. Every citizen shall have the right to freedom of speech, so long as it does not actively and intentionally provoke or offend others, threaten their rights or damage the security of the Commonwealth. II. Every citizen is entitled to equal and fair protection under the law. III. Every citizen is entitled to a free and fair trial. IV. Every citizen put on trial is to be treated as innocent until proven guilty. V. Any person may apply for citizenship, and be approved or denied by the Chancellor, Vice Chancellor or the Magister of Citizenship. VI. A prospective citizen of the Commonwealth must have a declared nation in the region of Grand Central. VII. If a citizen of the Commonwealth holds a WA nation in the region and is not mobile for the purpose of raiding or defending, they are compelled to endorse the Lord Protector for the security of the region. VIII. The founder of Grand Central is automatically and permanently entitled to citizenship, and is immune to prosecution by the government. Article VI I. The Commonwealth and its government is also tasked with recognizing long-term citizens who have contributed greatly to the livelihood of the region. For this purpose, the Marquisate of the Commonwealth is established. II. A Marquis or Marquess is a person (regardless of citizenship) recognized by the Chancellor as a significant contributor to Grand Central whose accomplishments and achievements contribute to the activity, reputation and stability of the region. III. While not legally empowered, the Marquisate and its members have an obligation to advise the government, and the Chancellor as well as other government members are encouraged to seek their advice. IV. Should a Marquis or Marquess fall from grace and their malheureux deeds overshadow their contribution, their status may be revoked by a majority vote of the Grand Congress. V. A Marquis or Marquess is entitled to citizenship regardless of if they have a nation in the region. VI. A Marquis or Marquess can be prosecuted, but a deciding verdict must be delivered by the Grand Congress, not the Chief Prosecutor. Article VII I. The Council of Magisters is the Cabinet of the Commonwealth, serving as the advisory of the Chancellor and a collective decision making body, with responsibility over specialized areas of governance. II. The Cabinet will be divided into Magisteriums, each headed by a Magister. A Magister will be appointed by the Chancellor and serve at their discretion. III. The Magisteria are as follows: a. Culture. Responsible for activities relating to roleplay, regional holidays, preservation of legislature and keeping the forum backed up. They may be granted admin status for the duration of their service to aid in their duties. Immigration. Responsible for going over and approving all citizenship applications, security checks etc. They are also responsible for providing any and all necessary information to the Grand Congress should they be called upon to review and vote upon a citizens continued citizenship. The Magister of Immigration can also appoint deputies to oversee the review of citizenship applications. b. Foreign Activities. Responsible for representing the region abroad. They appoint and approve ambassadors to and from other regions, approve forum embassies, answer diplomatic inquiries and aid the Lord Protector in determining military policy. They also are responsible for overseeing all alliances made in relation to raiding activities or military action. c. The Chief Prosecutor of the Commonwealth. Tasked with trying accused criminals and enemies of the Commonwealth. The Chief Prosecutor can be ordered by the Chancellor alone to prosecute and open cases. d. The Lord Commander. Responsible for the upkeep of any standing military that the Commonwealth establishes, by proclamation of the Lord Commander or by legislation. The Lord Commander is tasked with the active protection of the Commonwealth’s interests both at home and abroad, be it by invading, defending, or assisting allies. Should a military be established, the Lord Commander is charged with keeping it, including leading raids, making promotions and demotions, choosing officers, making appropriate changes to rank structure and determining targets along with the Magister of Foreign Activities. They will also coordinate all military recruitment with the Lord Protector, Chancellor and Magister of Immigration. IV. By consensus, the Council, as well as the Chancellor, Vice Chancellor and Lord Protector, can enact temporary executive orders related to their department in regards to policy or procedure. These orders will take effect for a period of two weeks and can at any time be overridden by the Grand Congress. At the end of the two week period the Magisters need approval from the Grand Congress by a majority vote to continue said executive order or can petition to have it voted into law. Article VIII I. Any law passed by the Grand Congress can be challenged by a citizen, on constitutional grounds. II. The supreme authority for the interpretation of disputed constitutional text is the Grand Magister of Justice. III. The Grand Magister of Justice is charged with upholding the fairness of the law and sorting disputes over its content. IV. The Grand Magister of Justice shall be appointed by the Chancellor and confirmed by the Grand Congress with a simple majority, serving for a period of three months until re-confirmed for another term or resigning. V. The Grand Magister can be recalled by the Grand Congress by a two thirds majority if he is found to be abusing his constitutional authority. VI. The Grand Magister of Justice will lose his voting power in the Grand Congress, however, is given a tie-breaking vote on legislation should the voting deadlock. Article IX I. The tri-monthly election of the Chancellor shall be overseen by the Grand Magister of Justice, who will open voting, close voting and tally the votes. II. Elections for the office of Chancellor will be held in an instant-runoff system, where voters rank their preferences. If no candidate achieves a simple majority, the last place candidate are eliminated and their voters’ second, third, et cetera preferences tallied until one candidate achieves fifty percent of the vote. III. Should a statistical tie occur, the winner will be chosen by the Grand Magister of Justice. IV. The nomination period will last three days, the campaigning period five, and the voting period five. After which, the Grand Magister will tally the votes and proclaim a winner, who will ascend the office three days after their victory. V. Only members of the Grand Congress may vote for the Chancellor. |
