In most states of Australia subcontractors are 'deemed' to be employees/workers for the purposes of workers compensation. If you are injured whilst performing work for ISGM it is their responsibility to pay you compensation for the period you are off work due to a work related injury. In Victoria every injured subbie has had their compensation claim rejected by their own insurer and been referred to ISGM. ISGM has had no choice but to accept this position. Now ISGM are trying to get around their WorkCover obligations by changing your contract to get around this. Most subbies don't realise that they are deemed to be employees/workers for the purposes of workers comp until they are injured and their own insurer knocks back their claim and tells them to send their claim to ISGM. You can check the law in your state at the links below: WA: http://www.workcover.wa.gov.au/employers/understanding-your-rights-obligations/covering-your-workers/contractors-subcontractors/ VIC: http://www.worksafe.vic.gov.au/laws-and-regulations/employer-rights-and-responsibilities ACT: http://www.worksafe.act.gov.au/page/view/1450/title/sub-contracting-and-workers NSW: http://www.workcover.nsw.gov.au/insurance/workers-compensation-insurance-for-your-business/who-to-insure/principal-contractor-issues QLD: https://www.worksafe.qld.gov.au/construction/articles/is-your-contractor-actually-a-worker NT: http://www.worksafe.nt.gov.au/Legislation/Documents/info for_hsr_whs.pdf TAS: http://worksafe.tas.gov.au/compensation/employers Edited by subbiesupport, November 17, 2015, 6:49 pm.
