Constitution of the Federation of Atlas We the people of the Utopian Progressive Council of Cardoness and the natives of the Island of Atlas, Having gone far into the Multiverse to find other peoples who share our desire for knowledge and wisdom, Having invited those we found to join with us in creating a great alliance to further our shared ideals, Do hereby create the Federation of Atlas and establish this Constitution for the same, To govern those that are willing to join us, To promote peace among the regions, To defend those unable to defend themselves, To work with International bodies to spread our ideals, And, To promote the free exchange of ideas and the free movement of peoples between members. Article I There shall be a Magistrate of the Federation of Atlas, who shall be from Cardoness. The Magistrate shall be vested with the judicial authority of the Federation. This judicial authority shall extend to all cases in law and equity arising within this Federation or any of its territories, or any other case in which all parties are agreed to submit to judgment. The Magistrate may create lesser courts and appoint judges for them as shall be deemed necessary. Rulings made by such courts may be appealed to the Magistrate. The Magistrate shall be vested with the power to declare a State of Emergency. A State of Emergency may only be declared to resolve a crises which cannot be resolved by the government in a timely manner, or in cases in which the government has ceased to function. Upon such a declaration, the Magistrate shall assume complete and absolute control, and may act with the full power of the Federation. A State of Emergency may not last longer than the crises for which it was declared, and no action taken during the State of Emergency shall stand longer than seven days after its conclusion unless ratified by the High Council. The Magistrate shall fill any vacancy of an elected office by appointment subject to the confirmation of a majority of the citizens of the Federation voting. In the absence of the Magistrate, all powers shall be temporarily vested in the Right Hand until such time as the Magistrate shall return. If there is no active Right Hand, then the President of the Federation of Atlas shall assume such powers. Article II There shall be a President of the Federation of Atlas, who shall be the Head of State. The President shall be vested with the executive authority of the Federation. The President shall, with the advice and consent of the High Council, have the power to appoint the Vice-President of the Federation, the Minister of Foreign Affairs, establish embassies or receive the same, appoint ambassadors, establish alliances or dissolve the same, appoint the Minister of Defense, appoint officers of the Peacekeeping Forces, and to establish or dissolve territories and appoint Governors for them. The President may appoint other special advisers as shall be deemed necessary. The President shall be the Commander-in-Chief of the Peacekeeping Forces. The President may require the opinion, in writing, of any of the principle ministers of the Federation upon any subject relating to the duties of their respective offices. The President shall have the power to grant reprieves and pardons for offenses committed against the Federation, except for impeachment. The President shall submit a report to the High Council each month detailing the state of the Federation, actions taken by the President in the proceeding month, and planned actions for the following month or indeterminate future. The President may not hold any other office, except by special appointment of the Magistrate, while serving as President. The President shall serve a one year term. The election for President shall begin on the third Monday of August and run for seven days. The President shall take office on the first of September. Only a Citizen who has been a resident of the Island of Atlas, or one of its territories, for at least four months, and who has been previously elected to another office may run for President. No person may hold more than two consecutive terms as President. Any person who shall become President by means other than election, and who shall serve more than one hundred and eighty-two (182) days in that capacity, shall be considered to have served a term. The President may be impeached upon the vote of two-thirds of the members of the High Council, for abandonment of the Federation, treason against the Federation, or other crimes. There shall be a Vice-President, appointed in the manner prescribed above, who shall act as President in the absence or inability of the President. The Vice-President shall become President upon the CTE, resignation, or impeachment of the President. The Vice-President may be impeached upon the vote of two-thirds of the members of the High Council, for abandonment of the Federation, treason against the Federation, or other crimes. No person may be appointed Vice-President unless they are eligible to be President. Article III There shall be a Prime Minister of the Federation of Atlas, who shall be the Head of the Government. The Prime Minister shall be vested with the power to govern the Island of Atlas. The Prime Minister shall be the Chairperson of the High Council, but shall have no vote unless they be equally divided. The Prime Minister may, with the advice and consent of the High Council, appoint the Minister of the Interior, the Minister of Member Relations and Recruitment, the Minister of Research, the Minister of Event Management (Role Playing), and any other senior Ministers the Prime Minister deems necessary. The Prime Minister may appoint other special advisers as shall be deemed necessary. The Prime Minister shall not hold any other office, except for that of Vice-President or any special appointment of the Magistrate, while serving as Prime Minister. The Prime Minister shall serve a one year term. The election for Prime Minister shall begin on the third Monday of September and run for seven days. The Prime Minister shall take office on the first of October. Only a Citizen who has been a resident of the Island of Atlas, or one of its territories, for at least two months, and who has been previously elected to another office or served as a Minister of Government may run for Prime Minister. No person may hold more than two consecutive terms as Prime Minister. Any person who shall become Prime Minister by means other than election, and who shall serve more than one hundred and eighty-two (182) days in that capacity, shall be considered to have served a term. The Prime Minister may be impeached upon the vote of seven members of the High Council, for abandonment of the Federation, treason against the Federation, or other crimes. Article IV There shall be a High Council of the Federation of Atlas, which shall be the Legislature. The High Council shall have the power To exercise exclusive legislative authority over the Island of Atlas; To establish a uniform rule of Citizenship; To regulate trade and relations with other regions; To declare war and conclude peace; To make rules for the organization and regulation of the Peacekeeper Forces of the Federation; To act as an upper, revising, legislative house for the territories of the Federation; To advise the Magistrate, President, and Prime Minister on the execution of their duties. To make all laws which shall be necessary and proper. A majority of sitting High Councilors shall constitute a quorum. Every bill which shall have passed the High Council shall be first presented to the Prime Minister for approval. The Prime Minister may approve and pass the bill along to the President or refer it back to the High Council for their reconsideration. Upon such reconsideration, if the High Council passes the bill a second time the bill shall go directly to the President. Any bill passed but which the Prime Minister shall take no further action on shall be passed on to the President after 3 days. The President, upon receiving the bill, may sign the bill into law or veto the bill and send it back to the High Council with written objections. The vetoed bill may be passed into law by seven votes of the High Council. Any bill not signed by into law or vetoed by the President shall, after 7 days, be considered vetoed. The Magistrate may not interfere with the normal passage of a bill into law. The Magistrate may strike down any law deemed to be unconstitutional or otherwise contrary to the security or principles of the Island of Atlas. There shall be four High Councilors. Members of the High Council may hold any other office they may be legally appointed to. Each High Councilor shall serve a one year term. The election for High Councilor shall be one every three months, beginning on the third Monday of each October, January, April, and July, and run for seven days. The elected High Councilor shall take office on the first of the month following their election. Only a Citizen who has been a resident of the Island of Atlas, or one of its territories, for at least one month may run for High Councilor. No person may hold the same seat in the High Council for more than two consecutive terms. Any person who shall become a High Councilor by means other than election, and who shall serve more than one hundred and eighty-two (182) days in that capacity, shall be considered to have served a term. A High Councilor may be impeached upon the vote of two-thirds of the members of the High Council, excluding themselves, for abandonment of the Federation, treason against the Federation, or other crimes. Article V No bill of attainer or ex post facto law shall be passed. No preference shall be given by any law or regulation to one member over another, unless it be for all citizens over non-citizens. No title of Nobility shall be kept by, or granted to, any citizen. No person holding any office shall, without the consent of the High Council, accept and present, office, or title of any kind from any foreign region or leader. No citizen of the Federation shall be restricted from holding office or trust, or any number thereof, except where restricted by this Constitution. The privilege of the Writ of Habeas Corpus shall not be suspended unless in cases of rebellion or invasion the safety of the Island of Atlas may require it. No law shall be made establishing an official religion. No law shall be made prohibiting the free exercise of religion. No law shall be made restricting any member from the form of government they choose for themselves. No law shall be made abridging the freedom of speech. No law shall be made restricting the right of the people to petition the government, or any government official, for a redress of grievances. Article VI In the event of a tie in any election, the tying candidates shall enter a runoff election lasting for three days. If the runoff election results in a tie, the Magistrate shall select the winner from among the tying candidates. In cases of Impeachment, the Magistrate shall preside over the High Council but shall have no vote. The Magistrate may at their desecration grant special dispensation to members not meeting the requirements to hold an government office. Article VII Amendments to this Constitution may be passed in like manner as other laws, but shall additionally require the ratification of both the Magistrate and the citizens of the Island of Atlas. Article VIII This Constitution, and the laws which shall be made in pursuance thereof, and all treaties which shall be made, shall be the supreme law of the Island of Atlas, and all persons residing under the jurisdiction, and all government officials of the Federation of Atlas, shall be bound by it. |
