Second degree murder? You can go from not having enough to charge after the incident to second degree murder? IMO, it will be hard to get a conviction and if they dont then we will see real trouble. Manslaughter would have been easier to convict on....wow.
I thought the investigation switched from the Sanford police to the State Attorney. That's part of the whole controversy. That the Sanford police were negligent in their handling of the case.
Maybe so but doesn't second degree murder charges mean that Zimmerman had to show INTENT to kill?? Did Zimmerman intend to kill Martin from the start of this situation? IMO, it will be very hard to get a conviction on that unless someone comes forward with knowledge of Zimmerman clearly stating his intent before the incident. Try to quiet the community and ease the tension with a charge that you can't get a conviction on is dangerous. If she can't get a conviction, prepare for some huge fireworks.
With the help of wikipedia:

First Degree Murder is any murder that is willful and premeditated. Felony Murder is typically first degree.

Second Degree Murder is a murder that is not premeditated or planned in advance.

Voluntary Manslaughter sometimes called a "Heat of Passion" murder, is any intentional killing that involved no prior intent to kill, and which was committed under such circumstances that would "cause a reasonable person to become emotionally or mentally disturbed." Both this and second degree murder are committed on the spot, but the two differ in the magnitude of the circumstances surrounding the crime. For example, a bar fight that results in death would ordinarily constitute second degree murder. If that same bar fight stemmed from a discovery of infidelity, however, it may be mitigated to voluntary manslaughter.


In addition, although I am not sure about Florida, in some states it is possible to be charged with 2nd degree murder and found innocent of this charge but found guilty on the lesser charge of mansalughter.
On the murder trial that I was on the jury, that was the case. We could have found the defendant guilty of murder or of lesser charges.

I actually had a friend that was convicted of murdering his girlfriend back in 1996. He claimed he was cleaning his gun and it went off. I was with him and a few others the night before, but for some reason I was the only one (that was with him the night before) that didn't have to appear in court and testify.

My point is, I never in a million lifetimes would have suspected him of being capable of such an act. In fact, I had never even seen the guy pissed off, not once in the 15 years that I knew him. I eventually read the court transcripts online and came to my own conclusion that he had to have done it purposely through the evidence and the testimony that was given.

My point is, you never really know someone, and in this case, taking someone's word for it just has not been acceptable. This trial will most definitely be interesting, but at least it's on the proper stage now.

In the end, regardless of verdict, at least two lives have basically ended.

Martin's ended unjustly; Zimmerman, whether he is found guilty or innocent will never truly have the life or freedom that he had.

I wonder if his story is more marketable than say a Casey Anthony, should he be found not-guilty. Obviously there would be protests, but Anthony basically had no supporters other than her Mother, and Zimmerman does have supporters out there.

It looks like this is written by the investigators, who are now charging Zimmerman, so I wouldn't be surprised if it seems anti-Zimmerman.

The most interesting thing is that the affidavit says Zimmerman continues to pursue Martin and confronted him. That is way different than Zimmerman being jumped while walking back to his SUV. If they have evidence of that, I think it could blow the case out of the water.
