Constitution of Project Soul I – Parliment A - Elections (1) Elections for the Parliment shall be concurrent with the elections for The Chamberlain and shall be scheduled to happen every two months with three days between registration for elections and the opening of the election polls, with the polls remaining open for 48 hours. (2) The number of seats available in elections shall be either three, if there are less than/or five candidates running, and five, if there are more than five candidates running. (3) The candidates that attain the most votes shall be elected to serve as Ministers. (4) If two or more candidates tie in an election there shall be a runoff election where the only voting options shall be the previously tied candidates. If a runoff election results in another tie then those ministers that have already been elected shall decide out of the candidates in the runoff who shall serve as a minister. (5) If a minister either resigns or is removed from Parliment a by-election shall take place two days after such resignation or removal occurred. All other procedures shall be the same of other elections. (6) If a minister resigns or is removed less than two weeks before the next general elections then a by-election shall not be held. (7) If Parliment has less than three ministers and it's less than two weeks until the next general elections then the general elections shall be called on earlier and shall take place three days after Parliment has been reduced to less than three members. B - Procedures (1) Sessions of Parliment shall commence once all contested seats in Parliment are filled. (2) Voting shall be held through posting in Parliment. Abstentions shall not count towards, nor against, the establishment of a majority. (3) Legislation may not be introduced into the Parliment before it has been discussed for at least 48 hours in Parliment. (4) Legislations or motions shall be voted on for no less than 24 hours and no more than 48 hours or until all Ministers have voted. (5) In order for a bill proposal to pass through Parliment it must recieve a simple majority in favour. (6) Parliment may legislate on further procedures and rules as long as those do not conflict with those in this Constitution. C - Moderation (1) Upon the start of a session the ministers shall elect, via simple majority, a Speaker of the House. (2) The Speaker of the House shall be in charge of moderating debate within the Parliment, making sure ministers abide by the rules and procedures of Parliment. (3) The Speaker of the House shall present passed legislation before the Shinigami. (4) Ministers may choose to remove the Speaker of the House from such position if the motion is supported by at least a simple majoirty within the House. D - Removal (1) A Minister may be impeached by a majority vote of the Assembly of Souls. (2) If a Minister has failed to login or post in Parliment for more than one week they may be removed by a simple majority of the House. II – Assembly of Souls A - Membership (1) Membership of the Assembly of Souls will be granted jointly with Citizenship. (2) Any member of the Assembly of Souls that has lost citizenship shall lose membership of the Assembly of Souls. B - Procedures (1) Sessions of the Assembly of Souls shall commence once all contested seats in the Parliment are filled. (2) Voting shall be held through posting in the Assembly of Souls. Abstentions shall not count towards, nor against, the establishment of a majority. (3) No legislation or motion shall sit for more than 48 hours in the Popular Assembly. This period may be extended for no more than 48 hours by a simple majority of the Assembly of Souls. C - Moderation (1) The Monarch shall appoint a Secretary of the Assembly who shall serve at their pleasure. (2) The Secretary of the Assembly shall ensure that all procedures of the Assembly of Souls are duly followed. III – Shinigami A - Prerogatives (1) The Shinigami shall be allowed to grant and manage all titles of nobility and civilian and military orders. (2) The Shinigami must give assent to legislation presented before them in order for it to become law. If the Shinigamy explicitly does not give assent to a piece of legislation then it shall be taken back to the Senate where it'll require a majority of the Senate to overturn the requirement of assent. (3) The Shinigami shall be the Supreme Commander-in-Chief of the Armed Forces and may declare war and peace. (4) The Shinigami may grant pardons and commutations of sentence with the approval of the Courts. (5) The Shinigami shall observe all elections by creating registration and voting threads. (6) The Shinigami shall direct foreign policy and appoint the Director of Foreign Affairs. (7) The Shinigami shall be a non-voting member of the Senate. B - Succession (1) Upon a Shinigami's abdication their designated heir, the first on the line of succession, shall be crowned as the new Head Shinigami. (2) The Shinigami must maintain at all times at least two members in the line of succession. (3) The first in line of succession may not hold office in the Courts or serve as Chamberlain. (4) In the absence of a line of succession in the event of an abdication of the Shinigami, Parliment shall elect the new Head Shinigami. C - Regency (1) The Shinigami may at any time appoint a regent, thus granting them all the prerogatives the Shinigami holds for a pre-determined amount of time. (2) The Regent may not be member of Parliment or the Chamberlain. (3) In the event that the Head Shinigami has not posted within the regional forums for a week or more then a regency shall be automatically declared. (4) If a regency has lasted for more than one month then the throne shall be declare vacant and the next in line for sucession shall become the Monarch. D - Limitations (1) The Head Shinigami may not serve as a Senator, Chamberlain or as a member of the Judiciary. IV – Deathly Council A - Composition (1) The Deathly Council shall be headed by the Chamberlain, which shall direct internal policy. (2) The Deathly Council shall be composed by three Directors: Minister of Incarnation (internal affairs), Director of Grimmness (culture), and Director of Channeling (foreign affairs). (3) The Director of Channeling shall be appointed by the Shinigami and shall serve at their pleasure. (4) The Director of Incarnation and the Director of Grimmness shall be appointed by the Chamberlain. (5) More Directives may be created by Parliment through legislation. C - Removal (1) The Chamberlain may be removed by a majority of the Assembly of Souls. (1) Directors may be removed by a majority of the Assembly of Souls. V – Judicary A - Composition (1) The Court shall be composed by a maximum of three members. (2) The most senior member of the Court will be the High Magistrate and shall serve as the head of the Judiciary. (3) Members of the Court shall be appointed by the Shinigami and must be approved by Parliament with a simple majority. B - Procedures (1) Members of the Court must recuse themselves from giving judgement on a trial that involves them as a witness, defendant or member of the accusation. (2) The Court shall have the power to make its own rules and procedures. (3) Court rulings will be considered binding unless appealed, rulings on the interpretation of legislation will be binding unless appealed or the relevant legislation has been altered. (4) The High Magistrate may invalidate legislation, in whole or in part, if justified by a reason deemed valid by the majority of the Court. C - Removal (1) Members of the Court may be removed by the Parliament with a majority. VI – State of Emergency A - Declaration (1) The Head Shinigami may, declare a State of Emergency. B - Emergency Powers (1) During a State of Emergecny the Head Shinigami may declare parts of this Constitution, parts of other laws, and laws as a whole to be null for the duration of the State of Emergency. (2) During a State of Emergecny the Head Shinigami may appoint and dismiss members of the Deathly Council, including the Chamberlain, at their discretion. (3) This article or any of its sections cannot be declared null during the State of Emergency. (4) The Assembly of Souls shall continue in session for the duration of any State of Emergency. C - Emergency Ending (1) The Head Shinigami may, at any time, declare a State of Emergency over. (2) The Assembly of Souls may, with or without the consent of the The Shinigami, declare a State of Emergency over with 4/5 majority. VII – Ratification. Amemdment & Statute A - Ratification (1) This Constitution shall be ratified upon being voted on by all citizens of the region. (2) Upon ratification, a State of Emergency shall be immediately put into effect. B - Amending (1) Amendments to the Constitution shall require a 4/5 majority of Parliament. (2) Amendments to the Constitution shall require that a referendum be made no more than 48 hours after the amendment has recieved Heavenly assent. (3) In all other respects, amendments shall follow the same procedures as an ordinary proposed law in Parliament. C - Statute (1) No law may come into conflict with the Constitution. (2) Statue of Constitutional law may be granted to other laws, such will require a referendum to be called. |
