Constitution of the Ragerian Imperium

ARTICLE I - SOVEREIGN


1. The Imperial Highness, the Sovereign of The Ragerian Imperium and Her Holdings, henceforth referred to as The Sovereign, shall serve as the Head of State for the Ragerian Imperium.
2. The Sovereign possesses the power to remove any individuals from political office, including the Grand Councillor. Such an action may be overturned by a ¾ vote of the Citizens’ Assembly.
3. The Emperor shall serve as the Commander in Chief of the military of The Ragerian Imperium, known as The Ragerian Armada.
4. The Emperor may issue Edicts to govern the region from their throne. These may be overruled by a ¾ vote of the Citizens’ Assembly.
5. The Emperor shall have the power to give or withhold royal assent from legislation of the Citizens’ Assembly. If a bill does not gain the consent of the Emperor, it must either be disposed of or rewritten.
6. The Emperor shall have the power to impose legal banishment on any nation and forum account, unless such an action is overturned by a ¾ vote of the Citizens' Assembly.
7. The Emperor has the power to issue an executive pardon of any person convicted of a crime. This pardon can be overturned by a ¾ vote of the Citizens' Assembly.
8. The Emperor may immediately and without obstruction, revoke the citizenship of any Commonwealth citizen. This revocation may be overturned a majority vote of by the Citizens' Assembly.
9. The Emperor shall maintain sole ownership over the founder nation of The Ragerian Imperium, The Ragerian Imperium Discord server, and the root administrator account of the regional forums, as defined in the appendix.
10. The Emperor may grant and revoke titles of nobility from any citizen of The Ragerian Imperium.
11. The Emperor is required to name a successor, who will be defined as, and granted the office and title of, The Prince of the First Rank.
12. Upon the abdication of an Emperor, The Prince of the First Rank shall become Emperor and be charged with all the duties defined in this article.


ARTICLE II - GRAND COUNCILLOR


1. The office of Grand Councillor shall serve as the head of government for The Ragerian Imperium.
2. The Grand Councillor shall direct the executive policy of The Ragerian Imperium.
3. The Grand Councillor shall possess the power to convene emergency meetings of the Citizens' Assembly.
4. The Grand Councillor shall possess the power to appoint Councillors to existing executive departments and create new ones as he/she wills.
5. The Grand Councillor has the power, subject to the advice and consent of a majority of the Citizens' Assembly, to make treaties.
6. The Grand Councillor has the power to request a declaration of war by the Citizens' Assembly, which must be approved by a majority of it.
7. The Grand Councillor shall be granted the corresponding regional officer position with all powers enabled.
8. The Grand Councillor shall possess administration powers over the regional Discord server and may appoint others to aid in the moderation of the server.
9. The Grand Councillor is entitled to administration powers on the regional forums, as well as any of their chosen appointees to assist in those duties.
10. If they wish, the Grand Councillor should appoint a Deputy Grand Councillor to assist them in their duties and serve in their capacity as Grand Councillor in the event that they are declared incapable of performing their duties by the Emperor. The Grand Councillor may also themselves delegate their powers to the Deputy Grand Councillor for any temporary amount of time. The Deputy Grand Councillor will also, in the event of an impeachment of the Grand Councillor by the Citizens' Assembly, exercise the powers of Grand Councillor for the election period until a new one is elected.
11. The Grand Councillor serves as the Chief Advisor to the Emperor.
12. The Grand Councillor serves as the Speaker of the Imperial Council, responsible for organising Council meetings and delivering their collective opinion to the Sovereign.


ARTICLE III - THE CITIZENS’ ASSEMBLY


1. The legislative authority of The Ragerian Imperium shall be vested in the Citizens' Assembly, henceforth referred to as the Citizens' Assembly.
2. The Citizens' Assembly shall have the power to establish a uniform rule of naturalisation.
3. The Citizens' Assembly shall have the power to define crimes and their punishments.
4. The Citizens' Assembly shall have the power to declare war through a majority vote.
5. The Citizens' Assembly shall have the power to make all laws which shall be necessary and proper for carrying into execution the foregoing powers, and all other Powers vested by this Constitution in the Government of The Ragerian Imperium, or in any Department or Officer thereof.
6. No Bill of Attainder or ex post facto law shall be passed.
7. The Citizens' Assembly shall have the power to regulate the regional currency.
8. The Citizens' Assembly shall have the power to impeach the Grand Councillor, the Deputy Grand Councillor, the Councillor of Internal Affairs, the Councillor of External Affairs, any other Councillor, the Chief Justiciar, and any of the associate justiciars, with a ¾ majority vote.
9. Impeachments of justiciars and councillors are subject to the consent of the Sovereign
10. All Citizens serve as member of the Citizens’ Assembly.
11. Unless specified otherwise, the Citizens’ Assembly shall require a simple majority vote to pass.
12. Legislation proposed by a citizen on the floor of the assembly may be motioned for a vote after being on the floor for forty-eight hours.
13. The Citizens shall elect a Speaker every 8 weeks to preside over the Assembly.
14. The Speaker of the Citizens’ Assembly will then bring the bill to vote for 48 at the ballot box.
15. All bills passed by the assembly must then be delivered by the speaker of the aforementioned assembly to the visitor’s hall of the Sovereign's residence, where the Sovereign will provide assent to the bill if they so choose.


ARTICLE IV - JUSTICIARS


1. The judicial power of The Ragerian Imperium shall be vested in one supreme court, known as the Justiciars.
2. Justiciars preside over all trials, criminal and civil, in The Ragerian Imperium.
3. Judicial procedures shall be subject to laws and regulations as established by acts of the Citizens' Assembly.
4. The judicial power of justiciars shall only extend to citizens of The Ragerian Imperium, and members of their forum and discord server.
5. Justiciars possesses the sole right to final interpretation of the Constitution and rules on the constitutionality of acts of the Citizens' Assembly, royal decrees, and executive orders by the Grand Councillor.
6. The number of justiciars is subject to acts of the Citizens' Assembly, but shall not exceed 9, shall not be less than 1, and shall not be an even number.
7. Justiciars shall be composed of 1 Chief Justiciar and any associate justiciars he/she appoints, subject to the numerical restrictions laid out in this Constitution and in any acts of the Citizens' Assembly, as well as the majority consent of the citizens assembly.
8. The Chief Justiciar shall be appointed by the Sovereign, subject to the advice and consent of a majority of the Citizens' Assembly.
9. Justiciars shall serve until their resignation or impeachment by a ¾ supermajority the Citizens' Assembly.
10. Justiciars may not hold any other political position in The Ragerian Imperium at the time of their appointment and for the duration of their time spent in office.


ARTICLE V - BILL OF RIGHTS


1. Every citizen shall have the right to freedom of speech, so long as it does not actively and intentionally provoke or offend others, threaten their rights or damage the security of The Ragerian Imperium.
2. Every citizen is entitled to equal and fair protection under the law.
3. Every citizen is entitled to a free and fair trial by the justiciars.
4. Every citizen put on trial is to be treated as innocent until proven guilty.
5. Any person may apply for citizenship, and be approved or denied by the Sovereign or Grand Councillor.
6. A prospective citizen of The Ragerian Imperium must have a declared nation in the region of The Ragerian Imperium.
7. If a citizen of The Ragerian Imperium holds a WA nation in the region and is not mobile for the purpose of raiding or defending, they are compelled to endorse the World Assembly Delegate for the security of the region.


ARTICLE VI - CRIMINAL CODE


Part A - Guidelines


Section 1 - Applicability of this Code


1. In this Code, unless otherwise stated, the "Ragerian Imperium" shall mean all official means of communication for the Ragerian Imperium, as so declared through the Imperial Edict for the Creation of the Regional Administration.
2. This Code shall apply to the Ragerian Imperium.
3. No one, regardless of current position in the region shall be exempt from these provisions, including the Sovereign.
4. No crimes will be tried and punished for unless the victim wishes it to be so.


Section 2 - Attempt and Conspiracy


1. Any person who attempts to commit an offence shall be held liable as though they did in fact commit the offence.
2. Any person who conspires with another person to commit an offence shall be held liable as though they did in fact commit the offence.


Section 3 - Miscellaneous Provisions


1. The offences contained in this Code shall be criminal offences triable before the courts of the Ragerian Imperium.
2. Upon conviction for any criminal offence, a criminal shall be liable to be banned from the Ragerian Imperium, in the most severe cases, or ordered to complete any other punishment which may be deemed appropriate by the trial justiciar.
3. If this Code does not specify a minimum sentence upon conviction then the sentence shall be at the discretion of the trial justiciar, provided that it shall be proportionate to the crime and the criminal's level of blameworthiness.






Part B - Offences Against Regional Security


Section 4 - Treason
1. A person is guilty of treason if they attempt to undermine the continued existence of the Ragerian Imperium, or if they aid or support, in any manner, a region with which the Ragerian Imperium is at war.
2. The sentence upon conviction for treason shall not be less than a two month ban.


Section 5 - Espionage


1. A person is guilty of espionage if they discloses to an unauthorized person, or obtains in order to disclose to an unauthorized person, confidential or sensitive government information.
2. The sentence upon conviction for espionage shall not be less than a one month ban.


Section 6 - Sabotage
1. A person is guilty of sabotage if they act in a way that is likely to cause harm to the Ragerian Imperium or their interests.
2. The sentence upon conviction for sabotage shall not be less than a one month ban.


Section 7 - Corruption


1. A public official is guilty of corruption if they use the powers of their office as a means to further the personal interests of themselves or their allies.
2. The sentence upon conviction for corruption shall be removal from public office and a ban on holding any public office for an amount of time to be determined by the trial justiciar.


Section 8 - Abuse of Power


1. An administrator or moderator of either the forums, NationStates region, or Discord server of the Ragerian Imperium is guilty of abuse of administrative powers if they, without a court order or the due authorization of the law:
2. intentionally bans a citizen from the region, or
3. intentionally deletes or hides any lawfully-made posts or any part of a lawfully-made signature or avatar, or
4. performs official actions outside of the description of their public office.
5. The sentence upon conviction for abuse of power shall not be less than removal of administrative powers and a ban from public service for an amount of time to be determined by the trial justiciar.


Section 9 - Impersonation of a Public Official


1. A person is guilty of impersonating an official if they presents themself as holding a governmental office or other official authorization or sanction which they do not in fact hold.
2. The sentence shall not be less than a ban from holding office for an amount of time to be determined by the trial justiciar.






Part III - Offences Against the Public Order


Section 10 - Malicious Trolling


1. A person is guilty of trolling if they sends or posts, in public or in private, grossly offensive material, or material that is so vexatious as to be likely to cause harm to the regional peace.


Section 11 - Harassment


1. A person is guilty of harassment if they send or posts material, in public or in private, that is likely to cause distress to another person.


Section 12 - Obscene Communications


1. A person is guilty of making obscene communications if they communicate in any way whatsoever any material which would disgust or outrage a reasonable person viewing such material (ie. Pornographic imagery, drug related, etc.)


Section 13 - Violation of Privacy


1. A person (A) is guilty of violation of privacy if they reveals any real-life personal information about another person (B) without B's consent.
2. The sentence upon conviction for violation of privacy shall not be less than a eight week ban.


Section 14 - Blackmail


1. A person is guilty of blackmail if they uses private information about another person in order to intimidate, distress or otherwise harm that person.
2. The sentence upon conviction for blackmail shall not be less than a three week ban and a ban from public office for an amount of time to be determined by the trial justiciar.


Part IV - Offences Against Justice


Section 15 - Perjury


1. A person is guilty of perjury if they willfully tells an untruth in court after having taken an oath or affirmation.
2. The sentence upon conviction for perjury shall not be less than ineligibility to stand as a witness for 2 months and their immediate removal from the case at hand, unless they are the defendant in which case they will be found guilty for the crime they are charged with and the additional charge of perjury




Section 16 - Failure to Comply With a Court Order


1. A person is guilty of failure to comply with a court order if they do not comply with a validly made court order within the timeframe specified in the order.
2. A person shall temporarily cease to be liable if they lodge an application to appeal the order as soon as is reasonably possible after the order is made.
3. A valid appeal is defined as presenting a reasonable excuse as to your absence and it being accepted by an officer of the courts
4. A witness found guilty of failure to comply, will be banned from being a witness for 4 weeks.
5. If the accused fails to comply with a court order by not appearing at their trial, they shall be found guilty for the offence they are charged with.
6. The accused can avoid this by appointing an appropriate representative to the case
7. Any unbecoming conduct by this representative will lead to both the accused and their representative being charged with contempt of court
8. If someone convicted of a crime attempts to evade their sentence, they shall be guilty of failure to comply with a court order and shall face a permanent ban from the Ragerian Imperium.




Section 17 - Contempt of Court


1. Contempt of court is the offence of being disobedient to or disrespectful towards a court of law and its officers in the form of behaviour that opposes or defies authority, justice, and dignity of the court.
2. The punishment shall be no less than a 2 week ban from being a witness.


Section 18 - Powers to Deal with Spam


1. Where an administrator or moderator is made aware of material that they believe constitutes spam, or is grossly offensive or obscene, they may hide such material from public viewing without obtaining a court order if and only if NS moderation would deem inappropriate.The NS moderators must immediately be contacted, and if the NS moderators have not removed it within 24 hours, it must be unsuppressed.
2. An administrator or moderator exercising powers under subsection 19(I) shall immediately notify any member whose material they have hidden.
3. Any material that is hidden in accordance with subsection 19(I) may not be deleted for 48 hours and must be made available upon demand for review by a judge. The material may be deleted after 48 hours have elapsed and the act of hiding has not been challenged in court.
4. Where an administrator believes that a member of the Ragerian Imperium is solely in the Ragerian Imperium for the purpose of spamming, they may ban, without trial, such a member.




Part V - Residual Powers


Section 19 - Powers Related to Real-Life Crimes


1. Where an administrator reasonably believes that a real-life crime has been committed, they may hide any posts related to that real-life crime and may ban, without trial, any person whom they suspects of committing that real-life crime.


Section 20 - NS Rule Violations


1. Any actions by a player which break NS rules fall under the jurisdiction of the NS mods and are to be reported to the moderators to deal with according to NS rules, including sections 10 through 15, if the offence takes place on the NS site.


ARTICLE VII - MODE OF AMENDMENT


1. Amendments must originate in the Citizens' Assembly.
2. Once an amendment has been proposed, it is subject to approval by the Citizens' Assembly through a 2/3 vote.
3. Once an amendment has been approved by the Citizens' Assembly, it must be approved by the Sovereign.
