I was thinking about changing things up a bit. So here's my idea: We do two things via constitutional amendment. 1) Strike out the line about no crime shall be tried unless the victim wishes it in the CC, as "victim" gets ambiguous when you have crimes against the state, such as treason. and 2) Split the criminal code off from the constitution. It should never have been attached to it in the first place. Now, you may be wondering why I titled the post Department of Justice. The next thing, beyond statutory law and such, is this: We create a new department called the Department of Justice. It is headed by the Chief Justicar and a new office, called the Attorney-General. It consists of attorneys who's job it is to prosecute state-related crimes. And then we also establish a Ragerian Bar Association, and set requirements to become a lawyer. I'm not expecting all of this to happen in one act, but I do hope that we can get somewhere with my first two points about the criminal code. The part after that is to take adantage of the new options available to us under the changes. Personally, as long as we're doing this, I'd advocate a rewrite of the criminal code entirely, but that might just be me. Anyways, what do you think? |

When I draft bills, I tag with [discussion] so thar they can be refined before being motioned. The CA forums are a perfectly acceptable place for these to go, as they directly pertain to future legislation. If you want me to make it more formal, I'll gladly write something up, but I wanted feedback on the idea before I threw out a bill. |
