The Habitus of Elysia

[pindent]Ratified: January 7, 2017[/pindent]

The people of Elysia do hereby establish our Realm, united within the Sovereign Imperial Realms under King Tabriz to act with the authority given by the Providence Papers to fulfill the responsibilities therein and to provide for the welfare of its citizens individually and as a whole.

Article 1:

Section 1: The Branches of Government
[Pindent]The government of Elyisa shall be divided into three distinct branches. There shall be two branches designated to interoperate and create laws, and a third branch to administer them and oversee the region. The High Council shall be one of two legislative branches, and shall be the voice of the citizens in the regional government. The Curia Regis shall be the voice of the realm's royalty, and shall be specifically tasked with the selection of the King. The King shall be the figurehead of the Royal Court, which shall be composed of the King and his cabinet.[/pindent]

Section 2: The High Council
[Pindent]The High Council shall be composed of delegates elected by the citizens of Elysia. The High Council shall be tasked with drafting, establishing, amending, and repealing legislation. It shall be composed of 7 members, 6 of whom shall be elected on the first of every month, and the seventh whom shall be elected every other month. The seventh member of the High Council shall be the Council's Chairman, and is to be the WA delegate of Elyisa. The Chairman shall be tasked with overseeing the proceedings of the High Council and calling for the impeachment of members. For a delegate to be impeached, a special hearing must be held by the High Council in which by a 2/3 majority, the delegate may be removed from office. The King of Elysia may call for the impeachment of the Chairman. During impeachment proceedings, the delegate in question shall be removed from the vote and not count towards the 2/3 majority quotient. The High Council shall carry out all Judicial Proceedings, presided over by the Chairman. Verdicts shall pass if four votes are in favor and the reasoning behind the verdict shall be published as soon as deliberation is complete. Verdicts shall pass in the same method as legislation. The High Council shall pass, repeal, and amend laws through a simple majority vote. Voting ends when either four votes are cast for or against a proposal, or once a 24 hour span has concluded. The King of Elysia reserves the right to veto legislation, in which case the Curia Regis may pass it by a 2/3 majority. A nation may simultaneously hold a seat in the High Council and the Curia Regis. The High Council shall serve as the court of Elyisa, and verdicts shall be passed in the same manner as legislation.[/pindent]

Section 3: The Curia Regis
[Pindent]The Curia Regis shall be composed of all standing royalty in Elysia. The Curia Regis shall be tasked with drafting, establishing, amending, and repealing legislation, as well as serving as the pool for the Electors. A royalty may never be removed from the Curia Regis, unless they are excommunicated. The Curia Regis shall pass, repeal, and amend laws through a simple majority vote. Voting ends when either four votes are cast for or against a proposal, or once a 24 hour span has concluded. The King of Elysia reserves the right to veto legislation, in which case the High Council may pass it by a 2/3 majority. The king is not a member of the Curia Regis.[/pindent]

Section 4: The Royal Court
[pindent]The Royal Court shall be composed of the King of Elysia and his selected cabinet. The King of Elysia shall be the figurehead of both interregional and regional affairs, as well as enforce and carry out laws, and veto legislation. To achieve these means, the king may appoint citizens to the Royal Court, which shall be composed of any and all positions the King creates to enable him to carry out his responsibilities. At any time, the King may establish, dissolve, or withhold a position in the Royal Court. The King shall be selected by the Electors of the region, of which there must at all times be 7 for a king to be selected. Six of the Electors must be members of the Curia Regis, and shall be elected a month before the King's selection by a vote comprised of all citizens. The Electors will convene once every six months to select the successor of the King of Elysia. The King himself shall hold a seat as an Elector. The King of Elysia shall be impeached, if a 48 hour long voting session is held in both the Curia Regis, and the High Council, in which 2/3 of all standing members vote in favor of impeaching the King. During this situation, the line of succession shall be as follows: Spouse of the King, children of the King by age. If there are no viable successors, than the legislative branches shall govern the region until a vote including all citizens can be held to select the new King of Elysia.[/pindent]


Article 2:

Section 1: Royalty
[Pindent]Royalty shall be initially established by the first king of Elysia. To become apart of the Royal family, one must either marry a member of the royal family, or be adopted by a pre-existing couple. As par the laws of the Providence Papers, all statesman are eligible to become Royalty. To marry into a family, you must receive the permission of the spouse you intend to marry. To be adopted, you must receive the permission of both the parents in your adoption. For a statesman to establish their own Royal family, they must appeal to the Court of Kings that oversees SIR, and by a majority vote, have the creation of their family approved. No laws may ever specifically target a family, and all Statesman reserve the right to create, and join Royal families.[/pindent]


Article 3:

Section 1: Aims of Elysia
[Pindent]Elysia shall provide diplomatic services to the SIR, shall offer mediation for disputes between realms of the SIR, shall promote the SIR to nations outside it, as such is necessary and requested by the SIR to benefit the Realms as a whole or in part, and shall establish and maintain Embassies in-game and through off-site infrastructure as deemed important and beneficial by the SIR. Section 2: Limitations
[Pindent]The powers over foreign relations and citizenship are to be wholly vested in the Sovereign Imperial Realms, and those whom power has been vested upon by the Sovereign Imperial Realms and shall not be hindered or interfered with by Elysia.[/pindent]


Article 4:

Section 1: Amendments to the Habtitus
[Pindent]The Habitus may be amended by provisions conforming to the Providence Papers by a 2/3 majority in both the High Council and the Curia Regis, with the approval of the King of Elysia.[/pindent]


Article 5:

Section 1: Rights of Citizens
[Pindent]All citizens have the right to free expression and possession of ideas in all mediums, no citizen shall be forced to express or reject said expressions.

All citizens reserve the right to association, including the right to create and join political parties for the protection and advancement of their interests. The freedom of association is guaranteed, and no citizen may be forced to join any association or remain within one.

All citizens have the right to equal treatment under law, and a prompt and fair trial.

The lack of enumeration whiten the Habitus shall not deprive the people of any right thereof.[/pindent]




Definitions

[Pindent]Majority - A plurality of the votes cast on a given topic resulting in more votes in favor of said topic.

Excommunicate - The head of a family tree, or a King of a family, may issue an excommunication of a member of their royal family. This revokes the royal status of the excommunicated figure, and bars them from re-joining the royal family. They must either establish their own, or join a separate family.

Elections - All elections are to last 24 hours

Votes - All votes are to last for 24 hours[/pindent]
