The Constitution of Selene

Article I: The Executive Branch

Section 1: The Monarch

1. The Monarch shall be defined as the founder of Selene.

2. The Monarch shall reign eternally on the throne of Selene.

3. The Monarch shall have the ability to appoint any citizen to his Royal Court.

4. The Monarch shall reign jointly as the Chief Executive with the Prime Minister.

5. The Monarch shall be the executor of all elections.

6. The Monarch may not be a part of any Guild.

7. The Monarch has the right to change the title of any Citizen of Selene.

8. The Monarch shall, after the election of Prime Minister, have the authority to officially appoint said Prime Minister.

9. Should the Senate be tied, the Monarch shall have the ability to break the tie.

10. Before the region has elected its first Senate and Prime Minister, the Monarch has all authority of law.

Section 2: The Prime Minister

1. The Prime Minister shall be up for election every 90 days by the citizens of Selene, or whenever the Prime Minister should resign, or he/she should be impeached.

2. Should the Prime Minister resign or be impeached, he/she will still act as the Prime Minister until the elections for the next Prime Minister are held.

3. The Prime Minister shall reign jointly as the Chief Executive with the Monarch.

4. The Prime Minister may not be ejected.

Section 3: The Joint Position of Chief Executive

1. The Chief Executives, The Prime Minister and The Monarch, to make any executive decision, must be in consensus. Should they fail to be in consensus, it will be considered as a Veto.

2. The Chief Executives shall have the sole ability to pass or veto bills.

3.The Chief Executives shall have the sole ability to appoint Lesser Ministers, The Chief Justice, and Regional Officers.

4. The Chief Executives shall have the sole ability to approve guilds.

Article II: The Legislative Branch

Section 1: The Guild

1. The Guild may only be founded by either a citizen with a tenure of one month or one of the first ten citizens to join Selene.

2. The Guild must first be approved by the Chief Executives.

3. The Guild must always have at least two members in it. If a guild has less than two members, it will have

4. 24 hours to come up with a second member, or cease to exist.

5. No citizen may be in more than one guild at any given time.

6. The Founder of the Guild shall be considered its initial leader. The government may not interfere with intraguild politics or happenings.

7. The Guilds shall have sole authority to appoint candidates for the Senate.

Section 2: The Senate

1. The Senate shall be chosen by the election of the guilds of Selene by the citizens of Selene. Based on the percentage each guild gets, that is how many seats that guild gets in the Senate.

2. The Senate shall be elected every 45 days.

3. Should a Senate seat become vacant, the Guild the Seat was won by shall choose a replacement from their own guild.

4. The Senate shall consist of the number of citizens in Selene, divided by 3, rounded down.

5. The Senate shall have the ability to make bills that relate to diplomacy, roleplay, guidelines for citizenship application and approval, penal codes, and the creation of a regional army.

6. The Senate shall have the sole ability to make and pass treaties.

7. The Senate shall have the ability to create its own procedural rules.

8. No member of the Senate may be ejected on any basis but the termination of their citizenship.

Article III: The Supreme Court

1. The Supreme Court of Selene shall consist of the Chief Justice, appointed by the Chief Executives.

2. The Chief Justice shall serve 1 year at most.

3. The Chief Justice may not also be serving in the Senate or as the Prime Minister or Monarch.

4. The Chief Justice shall have the ability, in cases not of Constitutional legality or appelation, to delegate his/her power to any citizen of Selene as a justice in an individual case.

5. The Supreme Court and its associate courts shall have the ability to declare any citizen of Selene a felon, and order their banjection and the revocation of their citizenship, save for the Monarch and Prime Minister.

6. The Supreme Court shall have the power to interpret the meaning of the Constitution and declare, based on this, laws constitutional or unconstitutional.

7. The Supreme Court and its associate courts shall have the right to execute any punishment within the law.

Article IV: Rights of Citizens

1. Each citizen has the right to run their own nation and account as they wish, within the rules of the website(s) on which they reside, save for in the case of the implementation of a WA cap.

2. Each citizen has the right to have nations in any other region they wish, except for regions actively at war with Selene.

3. Each citizen has the right to resign from any office they should wish to.

4. Each citizen has the right to a fair and speedy trial of their peers as an alternative to the Appointed Courts of Selene or the Supreme Court of Selene. However, should they choose to appeal, they may only appeal to the Supreme Court of Selene.

5. No citizen shall be forced to incriminate themselves.

6. Each citizen has the right to freedom of expression.

7. The Government may not discriminate against any citizen on basis of their natural state.

8. The writ of Habeas Corpus shall not be denied.

9. The Citizen shall have the sole right to run for office in Selene.

10. No Citizen may be ejected without trial, except for in cases of violation of a WA Cap.

Article V: States of Emergency

1. A State of Emergency is to be declared when the founder nation should cease to exist, the Monarch should fail to be active on the forums for 45 days, the population should fall below 10 citizens and/or 15 residents, or by a 3/4 majority bill of the Senate.

2. In a State of Emergency, The Monarch shall become the Dictator, or failing the ability of the Monarch to act as a Dictator, the Senate shall declare a Dictator. This Dictator shall have all authority of law, and shall be above the Constitution.

3. Should a Dictator fail to be appointed within 12 hours, the highest-ranking official shall become the Dictator.

Article VI: The Army

1. The Army may only be created by a 3/4 majority vote of the Senate.

2. The Army shall be led by a General, appointed by the Chief Executives.

3. The Army shall have no ability to invade any region.

4. The Army shall have no ability to banject the natives of any liberated region.

5. The Army shall have the ability to defend or liberate any region.

6. In a State of Emergency, all army resources shall be allocated to defending Selene.

Article VII: Elections

Section I: Elections for Prime Minister

1. The Prime Minister shall be elected by popular vote of the citizens of Selene.

2. No one may switch Guild affiliations a week or less before the end of the Prime Minister's term.

3. There shall be a period of 5 days of nominations, starting 10 days before the end of the term of the Prime Minister, ending 5 days before. To enter in the race, you must be nominated by another citizen of Selene.

4. There shall next be a debate period of 3 days, in which all candidates will be presented with a list of issues by the Monarch which they will have to state their positions on.

5. There shall next be a voting period of two days, at the end of which the Prime Minister shall be declared.

6. Should there be a tie in vote, the Monarch may cast a tiebreaker vote.

7. Should only one candidate be nominated, they shall be immediately elected.

Section II: Senate Elections

1. The Senate shall be elected by a popular vote election of the Guilds of Selene using Single Transferable Vote.

2. The Senate election period shall start 5 days before the end of a Senate session with a 3 day period of Guilds listing their candidates in order of their liking.

3. The citizens shall then vote.

4. The Guild shall obtain seats based on the number of seats they get proportionally and their ordered listing of candidates.

5. Should a Guild fail to come up with an appropriate amount of seats for their votes, their Guild shall choose a secondary guild to take their seats, and that choice shall be given the remaining seats.

Article VIII: Amendments

1. Amendments to this Constitution may be made only by a 2/3 majority in the Senate, with approval by the Chief Executives.
