Let's say a criminal commits a crime to the victim. If the victim is okay and forgives the criminal, should the criminal still be sent to court and prosecuted under the local/federal laws? After all, regardless of what the victim thinks, the criminal did indeed break a law. So should the criminal be sent free if the victim is cool with it, or should he still be sent to jail or have to pay a fine? |

Yes. While it might make the criminal more sympathetic, he still has that "criminal energy" and his next victim might not be so forgiving. |

Forgiveness should play no part in the decision to prosecute. If you break the law, you must face the consequences. |

A civil suit is between two parties. A criminal suit is the state vs. the criminal. Forgiveness may help during the sentencing phase, but has nothing to do with the state's intent to prosecute. |

Took the words right out of my mouth. Jinfeng might have said something similar (if I'm interpreting his post correctly), but I'm pretty darn certain that telling the criminal that he/she is forgiven without him/her facing the consequences will do very little, if anything, to make sure he/she doesn't do something similar again, or at least in the foreseeable future. The punishment might not necessarily do so either (depending on their personality), but I'm sure it has a better chance of doing so. |
