PREAMBLE We, the members of the United Republic shall uphold this constitution. ARTICLE 1 :: FUNDAMENTAL RIGHTS SECTION 1 :: EQUAL BEFORE THE LAW All persons in the United Republic of Nations, and its susidiary regions, shall be treated equally in equal circumstances. Discrimination on grounds of religion, belief, political opinion, race or sex or on any other grounds whatsoever shall not be permitted. SECTION 2 :: RIGHT TO VOTE 1. All members of the United Republic of Nations shall be equally eleigible for appointment to public service. 2. Every member of United Republic of Nations shall have an equal right to elect the members of the general representative body and to stand for election as a member of those bodies, as long as they are hold citizenship on the forums. SECTION 3 :: RIGHT TO PETITION Everyone shall have the right to submit petitions in writing to the competent authoritities. SECTION 4 :: RIGHT OF RELIGION 1. Everyone shall have the right to profess freely his religion or belief, either individually or in community with others, without prejudice to his responsibility under the law. 2. Rules concerning the exercise other than in buildings and enclosed places may be laid down by Act of Parliament for the protection of health and to combat or prevent disorder. SECTION 5 :: RIGHT OF OPINION 1. No one shall require prior permission to publish thoughts or opinions through the press, without prejudice to the responsibility of every person under the law. 2. The rules of the One Stop Rule Shop shall be followed by all members of the United Republic of Nations and its subsidiary regions. 3. No one shall be required to submit thoughts or opinions for prior approval in order to disseminate them by means other than those mentioned in the preceding paragraphs, without prejudice to the responsibility of every person under the law. SECTION 6 :: RIGHT OF ASSEMBLY The right of assembly and demonstration shall be recognised, without prejudice to the responsibility of everyone under the law. SECTION 7 :: NULLA POENA SINE LEGE No offence shall be punishable unless it was an offence under the law or this constitution at the time it was committed. SECTION 8 :: DUTY OF EVERYONE It shall be the concern of the authorities and the members to keep this region habitable and protect and improve the environment SECTION 9 :: DUTIES OF GOVERNMENT 1. Government shall take steps to promote the health of the population 2. It shall be the concern of the government to provide sufficient living accommodation 3. The government shall promote social and cultural development and leisure activities. SECTION 10 :: RIGHT OF EDUCATION The Government shall maintain a forum wherein information and links shall be stored of factbooks containing important information about NationStates, so members of the United Republic of Nations may learn from them. ARTICLE 2 :: THE LEGISLATURE SECTION 1 :: DESCRIPTION OF THE BODY 1. The Senate shall be the most powerful government body in this region, having Parliamentary Sovereignty but will not be more powerful than our constitution, having Constitutional Supremacy. 2. The Senate shall be an elected body of government with a set number of senators, able to grow as this constitution sets forth. 3. The Senate shall be unable to directly amend this constitution and shall not have the right to pass laws that conflict with this constitution. SECTION 2 :: MEMBERSHIP AND VACANCIES 1. The members of the Senate shall be known as Senators. 2. Each nation being resident in either the United Republic of Nations, or a subsidiary region, and is a citizen on the forums, may become candidate in the senate elections. 3. Senators shall be elected for a 2 month term. 4. The Senate shall consist of 3 senators and may be expanded every Senate General Election with 2 additional seats by the members of the Senate. 5. The elections for Senate will be divided into: General Elections and every other month Midterm Elections. 6. If a seat becomes vacant a by-election will be held, unless it happens less than 7 days before next elections in which the seat would have been up for election anyway. 7. If a senator has been inactive for more than 5 days without notice, his/her seat shall be considered vacant, thus removing the senator from office. SECTION 3 :: TASKS OF THE SENATEThe Senate of the United Republic of Nations shall have the tasks to: 1. Create functional legislation, Role-play legislation and Acts of Parliament. 2. Approve or disapprove embassies, alliances or any other form of agreements with other regions. 3. Act as the final court in civil or criminal cases, as a court of cassation and shall be regulated by Act of Parliament 4. Oversee the activities of the executive and may investigate those activities. 5. In case the founder ceases to exist additional powers shall be granted to the senate according to Article 7, Section 1. 6. In cases laid down by Act of Parliament senators may be suspended or dismissed. SECTION 4 :: SPEAKER OF THE SENATE 1. The Senate Speaker shall be elected by the senators among themselfs. 2. The Speaker shall be responsible for the organisation of the senate floors (draft, debate, pending, at vote, passed and failed legislation sub-forums) 3. The Senators and Directors, or anyone speaking in the senate, never speak directly against each other but always through or to the Speaker. ARTICLE 3 :: THE EXECUTIVE SECTION 1 :: DESCRIPTION OF THE BODY 1. The executive branch shall consist of a ceremonial president, a Non-Excutive WA Delegate and directional departments. 2. The president shall be elected by the members of the region, who are on the forums and masked as citizens or masks with the same status as citizens. 3. The directors shall be elected by the employees of the respective departments. 4. The WA Delegate shall be the person who received most endorsements, it is encouraged, by this constitution, to remain supporting a chosen WA Delegate for stability. 5. The Founder has executive authorities but unless he is elected to any of the above positions has merely a administrative function. SECTION 2 :: THE PRESIDENT OF THE UNITED REPUBLIC1. He/She shall be elected by the citizens for a 2 month term and shall have a ceremonial function. 2. He/She shall sign passed legislation but may refuse, this will have no effect. 3. He/She shall represent our region abroad, together with the Director of Foreign Affairs. 4. He/She shall appoint a Attorney General for a 2 month term. SECTION 3 :: THE WA DELEGATE OF THE UNITED REPUBLIC1. The WA Delegate shall be elected by the WA members of the United Republic through the endorsement system. 2. The WA Delegate may, or may not, be executive. The Founder has the right to change this at any time. 3. The WA Delegate shall represent our region in the WA. We expect from him/her that he/she will vote on resolutions proposed in the general assembly. 4. In case the founder ceases to exist, additional powers shall be granted to the WA Delegate according to Article 7, Section 1. SECTION 4 :: DEPARTMENTS 1. The executive branch shall be run by the individual departments, the departments shall be under the leadership of a director and are under the scrutiny of the senate. 2. The 3 departments will be State, Foreign Affairs and Culture. 3. New departments and its directors, as well as the tasks of each department and each director, shall be regulated by Act of Parliament. 4. The Departments must, in most cases, request approval from the senate for any action they would like to make. However, there are a few exceptions: Role-plays, recruitment telegrams, the welcome telegram and the work of ambassadors do not have to be approved but the senate must receive a notification of these events. SECTION 5 :: DIRECTORS OF DEPARTMENTS 1. The employees of each department shall elect a director for a 2 month term. 2. The director shall supervise and encourage the tasks, furthermore, he/she shall inform the senate of the situation regularly. 3. The director essentially holds no power and may be prosecuted if he/she breaches the constitution or the laws. SECTION 6 :: THE FOUNDER OF THE UNITED REPUBLIC 1. The Founder holds executive powers on NationStates and shall be responsible for the World Factbook Entry and protecting the region. 2. The Founder may, at his scrutiny, grant or deny executive powers to the WA Delegate. 3. The Founder is not a government funtion, but he may hold one, his position as founder cannot be taken from him if prosecuted. 4. This Section shall become obsolete when the founder ceases to exist and Article 7, section 1, shall be applied. ARTICLE 4 :: THE JUDICIAL SECTION 1 :: COURT OF THE UNITED REPUBLIC 1. The organisation, composition and powers of the judiciary shall be regulated by Act of Parliament 2. The adjucation of disputes involving rights under civil law shall be the responsibility of the judiciary. 3. The trial of offences shall also be the responsibility of the judiciary. 4. Disciplinary proceedings established by government bodies shall be regulated by Act of Parliament. 5. A sentence entailing deprivation of liberty may be imposed only by the judiciary. 6. Capitol punishment may not be imposed. 7. Appeal to a higher administrative authority shall be admissable, referring to the senate. 8. The constitutitonality of Acts of Parliament and treaties shall be reviewed by the courts. SECTION 2 :: JUSTICE OF THE UNITED REPUBLIC 1. The justice shall be elected by the members of the United Republic, who are members of the forums, during the midterms for a 2 month term. 2. The tasks of the justice shall be regulated by Act of Parliament. 3. In cases laid down by Act of Parliament the justice may be suspended or dismissed. SECTION 3 :: ATTORNEY GENERAL 1. The attorney general shall be appointed by the president for a 2 month term. 2. The tasks of the attorney general shall be regulated by Act of Parliament. 3. In cases laid down by Act of Parliament the attorney general may be suspended or dismissed. ARTICLE 5 :: ELECTIONS SECTION 1 :: GENERAL ELECTIONS 1. The general elections shall be held every 2 months. 2. 2/3 of the senate seats shall be up for election for a 2 months term. 3. The procedures and duration of the elections shall be laid down by Act of Parliament. SECTION 2 :: MIDETERM ELECTIONS 1. The midterms shall be held every other month, in which there are no general elections. 2. 1/3 of the senate seats shall be up for election for a 2 month term. 3. The president and the justice shall also be elected during the midterms. 4. The procedures and duration of the elections shall be laid down by Act of Parliament. SECTION 3 :: BY-ELECTIONS 1. A by-election can only take place if a seat in the senate or another elected position is empty for more than 7 days before position was up for election anyway. 2. The procedures and duration of the elections shall be laid down by Act of Parliament ARTICLE 6 :: CONSTITUTIONAL AMENDMENT SECTION 1 :: CONSTITUTIONAL REFERENDUMS 1. The senate and/or the citizens may propose modifications to the constitution. 2. The senate and/or the citizens must seek support of atleast 10 percent of active forum users in a "Constitutional Modification Initiative". The procedures and the duration of constitutional modification intiatives shall be regulated by Act of Parliament. 3. When the initiative reaches the minimum amount of supporters procedures shall be started to hold the referendum. These procedures and the duration of the referendum shall be regulated by Act of Parliament. 4. The referendum must have 2/3 of the voters voting FOR the constitutional amendment in order for the amendment to be implemented. SECTION 2 :: PROTECTION OF ARTICLE 6 Article 6 shall be protected and the senate and citizens of the United Republic shall be unable to change this article and its sections. ARTICLE 7 :: EMERGENCY PROVISIONS SECTION 1 :: FOUNDERLESS PROVISIONS In case the Founder ceases to exist (CTE) the Delegate and Senate shall receive the following powers: REGION The long time members of The United Republic of Nations may not leave the region, otherwise precious influence points will be lost and the region will become weaker and weaker but together we stand strong. DELEGATE 1. The Delegate shall, by NS rules, become executive and shall be a non-elected, permanent position as replacement of the Founder. In case the Delegate CTE's, the first Vice-Delegate shall become Delegate. 2. The influence of the delegate is crucial for regional security, all WA members must endorse the Delegate and Vice-Delegates 3. The Delegate shall appoint 2 Vice-Delegates who must be endorsed by all WA Members except the Delegate. 4. All other WA members must endorse eachother but the Vice-Delegates and the Delegate may not endorse the other members. Senate 1. The Senate shall appoint a nation who shall have the authority over Border Control. This must be an influential nation within the region. 2. He shall have the task to banject everyone who do not comply with this Section, without warning, from his first appointment. 3. The Senate may, at any time, appoint someone else. SECTION 2 :: PROVISIONS OF LAST RESORT IF THE UNITED REPUBLIC OF NATIONS HAS BEEN SEIZED BY INVADERS AND THE PEOPLE OF THE UNITED REPUBLIC ARE UNABLE TO REGAIN THE REGION, THE SENATE SHALL APPOINT A NEW FOUNDER, WHO WILL ESTABILISH A NEW REGION WITH A NEW NAME WHERE ALL MEMBERS CAN MOVE TO. EVERYTHING FROM THE CONSTITUTION, LAWS AND INSTITUTIONS SHALL BE TRANSFERRED TO THE NEW REGION AND THE NEW REGION CAN PROSPER AGAIN. Edited by Rhein, Apr 24 2018, 10:09 AM.
